Our attorneys have handled well over 100 intellectual property matters, with particular emphasis on trademark, trade secret, and copyright. We also have substantial experience in the prosecution of trademark registrations before the U.S. Patent and Trademark Office, counseling on the selection, clearance, and use of trademarks, and the policing of trademark rights.

REPRESENTATIVE MATTERS
  • As lead counsel for MGA, winning the retrial of Mattel v. MGA (aka “Barbie v. Bratz”), a billion-dollar “bet the company” copyright infringement and trade secret misappropriation case. MGA had lost a previous trial, been ordered to pay Mattel $100 /million in damages, and was forced to surrender the Bratz brand to Mattel. In the retrial, which Jennifer Keller entered just 12 days before trial began, the jury found that MGA owned the entire Bratz brand and rejected all of Mattel’s claims.
  • Representation of El Torito Restaurants in a high-profile trademark matter challenging the use of the term “Taco Tuesday” in which we secured a summary judgment on all claims.
  • Representation of Target Corp., Ralphs Grocery Co., Flight Test Historical Foundation, Shea Homes, Item Software, Korn/Ferry, and Playmates Toys, among others, in various trademark, service mark, tradename, and copyright litigation.
  • Representation of HomeAid, Inc. in pro bono trademark enforcement and policing matters.
